Afsatu trial: final judgment!
The legal battle between the State (Anti Corruption Commission) and the former Minister of Fisheries and Marine Resource, Afsatu Kabba will soon be concluded having been adjourned for final judgment.
The matter was called up by presiding judge, Samuel Ademusu who asked the prosecution and the defense about their final say on the last addresses submitted to the court.
The lead defense counsel, JB Jenkins Johnston, made an application to the court that the defense wants to submit a supplementary address because the prosecution, he said, submitted its written address late on Wednesday and thus the defense team needed to read the address and possibly submit a supplementary address.
He also informed the court that the defense had already prepared its written address before seeing the address of the prosecution and as such would want to address certain things the prosecution raised in its final submission.
The prosecuting lawyer for the ACC, CT Matsebo however objected to the application of the defense saying that there should not be any supplementary address to what has been tendered in court as was agreed between both parties in chamber.
JB Jenkins in reply to the objection made by CT Matsebo informed the court that according to the 1991 Constitution section 23 sub section (5) the court should give sufficient time to the accused person to prepare its defense in the spirit of fairness and justice.
Justice Ademusu however overruled the objection of Matsebo and said that he will allow both parties the defense and the prosecution to add supplementary to their written addresses and the matter was adjourned for Judgment as notices will be sent to both parties as to the date for final judgement.
