3 Docked for Domestic Violence

Francess Kanneh Lube, Ransford Arthur James Maxwell and Francis Metzeger, all of 28 Kissy Bye Pass Road Freetown, were past Wednesday arraigned before Magistrate Hannah Bonnie on two count charges of domestic violence contrary to section 2 (i) of Domestic Violence Act of 2007.

It was alleged that on Tuesday, 24th March 2015, at 28 Kissy Bye-Pass Road, Freetown, they physically abused uncle Ransford Seruda Lube. The accused persons registered a plea of not guilty.

The defense counsel, Lawyer A. Rogers applied for bail on the grounds that the accused was presumed innocent before the law, adding that the onus rests on prosecution to prove the accused beyond all reasonable doubts. Lawyer Rogers further canvassed the bench that the accused persons, notwithstanding the fact that they were in the dock, were law abiding citizens and that the complainant was the younger brother of Francess Kanneh Lube. He assured the bench that the accused once granted bail will not interfere with the witness and will always appear before the Court. Lawyer Rogers concluded by saying that he was making his application on section 79 (5) of the criminal procedure act of 1965.

The prosecutor Inspector Sorie Conteh raised no objection on the granting of bail to the accused persons.

THE Magistrate was however magnanimous by granting ten million Leones bail condition to the accused, one surety each who should surrender their bank statement to the Court, and that the bail document be approved by Master and Registrar, fulfilling the bail conditions. The matter will come up again this morning.
