African Minerals take five to court

African Minerals Limited has taken five people Mohamed Fofanah, George Sesay, Sambia Thaimu Sheriff, Idrissa Kamara and Ibrahim Umaru Solomon Koroma, to court.

These accused persons on Tuesday 1st April 2014 at Court No. 2 of magistrate Komba Kamanda in the Republic of Sierra Leone charged with two counts each. Count 1: Conspiracy contrary to law as the first accuse person Mohamed Fofanah and others conspire to commit a state of larceny on the 25th February 2014 at Pepel village Lokomasama Chiefdom in the Port Loko district Northern province of Sierra Leone allegedly stole a Lincoln 500 voltage welding Generator machine value Le119 million, property of African Minerals Limited and Count 2 is Larceny contrary to section 2 of the Larceny Act of 1916.

The Defense councils H. Serry and G. Conteh made their submissions to magistrate Komba Kamanda and H. Serry made an application for bail after hearing from the prosecuting Council A.S.P Dunia to take a date so that they could present their witnesses. He laid his defense pursue to Section 79 sub section 2&3 of the Criminal procedure Act of 1965 that the accused persons are Sierra Leoneans who will appear in court at any adjourned date and will not interfere with any witness if granted bail . He further went on to say that they have credible sorties who will be ready to bail the accused persons. 

Prosecuting Council A.S.P Dunia objected to the bail made by  the defense council due to the quantum of the Generator stolen, also said that they are not residents of Freetown, are a flight risk, and if granted bail will not only jump the bail but will fault the jurisdiction of the court.

In the final submission made by Komba Kamanda he said that because of the nature of the offence charged the accused are remanded in police custody until the adjourned date.

The case was later adjourned to 7th April 2014.
