High Court sanctions land minister
The Land and Property Division of the High Court of Sierra Leone has issued a ban sanctioning the Minister of Lands, his Deputy Minister, Permanent Secretary and the Director of Surveys to desist trespassing land owned by a private man.
Facts have it that the Land and Property Division of the High Court has legally banned the forenamed officials to hands off a parcel of land and hereditament lying and being at Off Smart Farm Road, George Brook, Freetown that forms part of the estate of the late Dr. John Abayomi Cole.
Citation in judgement submitted by Honourable Mrs. Justice A. Showers (J.A), in April this year quotes that “upon hearing the notice of motion herein dated the 12th day of April 2010, together with the Affidavit in support thereto, and the exhibits attached thereto;
AND UPON HEARING J.B. JENKINS-JOHSTON Esq. of Counsel for the Plaintiffs/Application herein. It is hereby ordered that the Plaintiffs/ Applicants are hereby granted LEAVE TO ISSUE A WRIT OF POSSESSION to recover possession of all that the land and hereditaments situate lying and being at OFF SMART FARM ROAD, GEORGE BROOK, Freetown as delineated on Survey Plan No. L.S. 2064/97 dated 5/2/98 covering an area of 96. 6189 Acres forming part of the Estate of Dr. John Abayomi-Cole (Deceased), pursuant to the judgement of the High Court dated 12th March 2010’. Copies of the said judgement and a cover letter from counsel for the plaintiff were dispatched to various authorities concerning a bid to discourage land grabbers and trespassers to refrain from encroaching in the said property.”
Be it known that this land saga started during periods of Dr. Bobson Sesay as Minister of Lands.
