Procedure Delays PMDC Case

The legal battle over the constitutional issue between the Chairman of the People’s Movement for Democratic Change (PMDC), Mohamed Bangura and the leader of the party, Mr. Charles Margai yesterday suffered a temporary hitch due to some technicalities and not on the substance of the matter itself.

Presiding Judge, Justice Brown Marke said the matter experienced a little hold up on the grounds that the earlier writ filed by the plaintiff bore no seal and was thus not properly before the court. This technical hitch, according court officials, was rectified yesterday and a sealed writ filed thus.

While addressing some of his supporters outside the court room yesterday, Chairman of the PMDC, Mr. Mohamed Bangura said the matter has been slated for another speedy hearing, relishing the hope that victory will soon come their way.

It will be recalled that Sierra Leone has recorded series of constitutional cases in her recent political history, but this is the first time a party member has to appear in court seeking an interpretation of the party’s constitution.

The case in question resulted from an action taken by the Secretary General of the PMDC who in a letter to the National Chairman of the party had suspended the latter from office, an action the Chairman has described as unconstitutional and has therefore resorted to court action.
