Election Petitions Brouhaha APC Refuse To Be Manipulated
Sierra Leone’s main opposition, All peoples Congress (APC) has stated in a press release dated Friday 14th February, 2020 that it did not trust the Judiciary of Sierra Leone to dispense justice.
This comes following the notices served on it legal team by the Appeals Court for the hearing on Monday 17th February, 2020 of appeals filed by ten ‘’illegally removed’’ Members of Parliament of the party.
According to the APC in its press release signed by its Secretary General, Ambassador Osman Foday Yansanneh (in photo), the Appeals Court lacks the Jurisdiction to hear such appeals since the Chief Justice blatantly failed to empanel Judges to hear and determine the appeals within four (4) months from the 11th of June, 2019 when the Notices of Appeal were filed.
This, the APC states, is a clear violation of the human rights and a complete denial of justice of its Members of Parliament who the party believes, were illegally removed from Parliament.
According to Section 78(4) of the 1991 Constitution of Sierra Leone, the release states, such appeals MUST be heard and completed within four (4) from the date they were filed.
‘’After several calls in various press releases, drawing the attention of the Judiciary from the party on the mandatory provision to empanel judges to hear and determine the appeals filed by the MPS fell on deaf ears, the Judiciary now has thought it fit to hear them after over eight months since they were filed’’ the release stated.
This, the APC believes, is a complete manipulation on the part of the Judiciary and therefore cannot be dragged to it.
To make matters worse, the APC states, one of the Judges empanelled to hear the appeals is a known ruling Party Member who contested for the ruling SLPP but lost to the APC candidate in the 2007 and 2012 election in Moyamba District.
With such a person in charge, it is the belief of the APC that justice cannot be dispensed and therefore cannot be manipulated into the Judiciary’s continued disregard for the rule of law, high-handedness and the injustice meted out on its party.
